Dear Friends,

HR. 2885 certainly has some beneficial aspects to those of us who support enforcement of U.S. immigration law.

 However, I don't think it is wise to trade away state authority for yet realized federal enforcement--especially when you consider the federal government's record.

Some of my friends (whom have made significant contributions to the cause of immigration law enforcement) believe the actual loss of state authority is narrow in scope and necessary to obtain the support of those groups who would otherwise be able to kill a national E-Verify mandate.

Sometimes we must agree to disagree and hope that the final outcome serves the nation well.

Your calls needed THIS MINUTE  to preserve state enforcement authority in HR 2885 (Legal Workforce Act)!

HR 2885 is helpful in that it mandates the use of E-Verify. However, HR 2885 also invalidates existing (and constitutional) state immigration enforcement ordinances and laws that mandate use of E-verify.

Please Call House Judiciary Committee members today and ask them to offer an amendment to the bill (or support an amendment by Congressman Steve King (R-Iowa), that would remove the "Preemption" clause in Section 6 of HR 2885 that invalidates state authority. 

SEC. 6. PREEMPTION

Section 274A(h)(2) of the Immigration and Nationality Act (8 U.S.C. 1324a(h)(2)) is amended to read as follows:

`(2) PREEMPTION- The provisions of this section preempt any State or local law, ordinance, policy, or rule, including any criminal or civil fine or penalty structure, insofar as they may now or hereafter relate to the hiring, continued employment, or status verification for employment eligibility purposes, of unauthorized aliens. A State, locality, municipality, or political subdivision may exercise its authority over business licensing and similar laws as a penalty for failure to use the verification system described in subsection (d) to verify employment eligibility when and as required under subsection (b).'.

 

 

Local and state legislation has been the only leverage we have had to address illegal immigration since the Obama administration has refused to adequately enforce U.S. Immigration laws.
